Ari Apartments Ltd (trading as Lyter Living) Terms and Conditions


By booking accommodation with Ari Apartments Ltd you are agreeing to the following terms and conditions. Please sign at the bottom of the page.

  1. The Booking


    Your booking is with Ari Apartments Ltd (referred to as Ari Apartments Ltd in these terms and conditions) which is a Limited Company registered in England and Wales 10874277


    1. References to you or your are references to the person or organisation making the booking with Ari Apartments Ltd.


    2. These terms apply to bookings made via the Ari Apartments Ltd website, by email or telephone or in person with Ari Apartments Ltd. Bookings made via any other booking site will be subject to their terms and conditions in addition to our own terms noted here.


    3. Your booking is confirmed and a legal contract concluded once your payment has been successfully made. No booking is made or contract concluded when payment is declined or unauthorised.


    4. You agree that the booking is for a short term stay for leisure, business or temporary purposes and does not give rise to an assured shorthold tenancy or lease and is an excluded agreement within the meaning of s.3A(7)(a) of the Protection from Eviction Act 1977.


    5. Bookings can be for any length from one night up to six months in accordance with the policies set for each apartment. Bookings may be made at any time up to 24 hours prior to your stay to enable us to check your status and credit card details are correct.


    6. Bookings may only be made by a person aged 25 or above and this person must be staying in the accommodation, there are exceptions to this which will be agreed by us prior to booking. Proof of ID is required as too is proof of address which must match that of the credit card used for payment.


    7. You may not re-sell or re-assign your booking to any other person or organisation except with the express authority of Ari Apartments Ltd.


  2. Payment and Cancellations


    1. All payments shall be made by Credit or Debit card, other payment methods are also used for direct bookings such as Paypal and Bank Transfers. Ari Apartments Ltd do not charge booking fees or credit or debit card fees unless we have taken your booking and you have requested a cancellation which has been approved by Ari Apartments Ltd.


    2. Full payment is required upon booking unless expressly agreed otherwise by Ari Apartments Ltd.

    3. The total price for your entire stay will be presented to you before you confirm your booking and make payment. Our pricing is dynamic and therefore the price for the same or similar accommodation may vary over time after your booking is made. This does not confer upon Ari Apartments Ltd any right to require additional payment where the price increases and does not confer any right on you to a discount if the price decreases.


    4. Both Ari Apartments Ltd and you may cancel the booking in accordance with the booking agents terms and conditions prior to the first day of your booking in which case a full refund will be made to you. For all direct bookings with Ari Apartments Ltd either party may cancel the booking 30 days prior to the first day of your booking. In both cases depending on the rate booked after this period the total amount will be payable.


    5. If you cancel the booking then Ari Apartments Ltd reserves the right to retain the full amount paid in accordance to the cancellation policy. Any refund will be at Ari Apartments Ltd’s entire discretion unless it is able to book out the accommodation to other guests, in which case it shall make a refund to you of your booking cost, less any difference in price where the replacement booking was off a lesser value. Any card fees for any refunds will also be charged to the guest.


    6. Ari Apartments Ltd reserves the right to cancel bookings where it is necessary due to reasons outside of Ari Apartments Ltd’s reasonable control or in the event of an overbooking due to delays or errors within the booking system. In the event of such cancellation the client will receive a full refund.


    7. Any fraudulent activity conducted by yourselves will be reported to the police with all your details. We do not tolerate fraudulent activity of any kind and therefore all documentation and ID must be presented within the timescales stated prior to your arrival.

  3. Your stay

    1. Check-in time is from 3pm and check-out time is no later than 10am, unless expressly agreed by Ari Apartments Ltd. Ari Apartments Ltd may request an additional payment for early check-in or later check-out. Information on the check-in and check-out procedure and access to the accommodation will be provided separately.


    2. Ari Apartments Ltd provide serviced accommodation rather than a hotel or guest house service. Ari Apartments Ltd do not provide meals or newspapers.


    3. Included in your room/apartment will be linen and towels, shower gel and shampoo. A cleaning service is provided and further information is available on request.


    4. Your accommodation will also include a supply of coffee, tea and sugar


    5. If you are a repeat customer you may be asked to sign the Terms & Conditions for each stay if there have been any changes made to the T&Cs or if your last stay was more than 30 days ago.


    6. You are responsible for the conduct of all persons staying within the accommodation and shall ensure that they comply with these terms and conditions. In particular, you and your guests must NOT:


      1. NO SMOKING in the premises. All rooms and common spaces including the balcony in our accommodation is STRICTLY non-smoking – you and other guests may only smoke outside of the premises in the designated smoking areas or well away from the building itself.

      2. Bring any pets into the premises, with the exception of assistance dogs or unless expressly agreed by Ari Apartments Ltd;

      3. Bring any potentially dangerous or hazardous materials or equipment onto the premises;

      4. Tamper with any fire alarms or emergency equipment;

      5. Remove, damage or destroy any Ari Apartments Ltd property;

      6. Use any technology provided by Ari Apartments Ltd to download or access any unlawful or obscene material;

      7. Cause unreasonable disturbance to our other guests/residents or any Ari Apartments Ltd staff;

      8. Make excessive noise particularly after 11pm especially from TV's and other electronic devices;

      9. Fail to return your room keys/fobs/cards at the end of your stay as, in the interests of security, we may have to replace the corresponding locks.

      10. Use the address to have any personal mail or parcels delivered without prior approval from Ari Apartments Ltd

      11. Use the address for applications for Visas

      12. No persons other than the guests have the right to access the property. Only the agreed number of guests are entitled to be in the property at any time. Please note that you will be charged for any extra guests within the property at £200 per person per night and this will be calculated for the duration of your stay.


    7. Interruption to services – we will make every effort to ensure that guest enjoy a comfortable, trouble free stay, however we cannot be held responsible for any failure or interruption of services to the property including and not limited to electricity, water, heating, or any damage to telephone, broadband and other communications.


    8. Access – Our staff and contractors have the right of access to the property at all reasonable times (and at all times in the case of an emergency) without notice to the guest. Please ensure the property is secured at all times when you are out.


  4. Regulatory Reform (Fire Safety) Order 2005 – The government has introduced some additional fire safety regulations for serviced apartments/holiday lets in the UK. The property will be compliant with all the Fire safety compliance and records will be kept for these. The guest also has some responsibility in ensuring the below points are adhered to.

    1. NO candles/tea lights or other items with open flames must be used in the property during your stay

    2. NO Smoking – Smokers are advised to smoke well away from the property and dispose of cigarette ends safely and must not be disposed of inside the property or nearby bins.

    3. Do not interfere with fire alarms or fire safety equipment

    4. Do no leave any personal items charging over night or when you are not in the property.

    5. You must not use any of your own personal electrical items unless they comply with the CE electrical legislation and have been PAT tested. CE marked items is an indicator of a product’s compliance with EU legislation.     6. Do not charge or store Electric bikes in your accommodation or charge EV via windows.


      Please ensure the following is adhered to:-

    7. All personal portable electrical appliances are switched off at the wall when you are not in the property, or overnight.

    8. Electrical items when charging including baby monitors are left on hard surfaces when charging and not on soft furnishings.

    9. The hob/cooker/oven is turned off when not in use and pans are not left on top of the hob.

    10. Fire escape routes MUST NOT be obstructed and they must be kept clear at all times.


  5. Damage, theft and costs


    1. Ari Apartments Ltd will take a damage deposit prior to your stay this can vary between £250 to

      £1000

    2. Ari Apartments Ltd reserves the right to charge to the credit/debit card used for payment or any other card used to provide security in respect of:

    3. The cost of replacing or repairing any property of Ari Apartments Ltd including furniture, upholstery, fittings, appliances or other fixtures and items which are damaged during your stay;

    4. The cost of replacing any items of property which are stolen from the accommodation during your stay

    5. Any breach of our non-smoking policy. A standard charge of £1000 will be charged to your card where we find evidence (including smell) of smoking within the accommodation and we reserve the right to charge additional amounts to cover any damage caused by smoking

  • £250 for non-return of keys (full set of replacement locks required)

  • £50 per day for late return of car park pass where applicable

  • £2000 for having a party or having guests exceeding the number of guests booked

  • £250 for Property not being left securely locked

  • £50/hr for late check-out

  • £50 per person per night for any additional guest not confirmed under the original booking.

  • Any call out charges incurred caused by yourselves such as setting the fire alarm off or loss of keys.

  • Any additional cleaning fees if the property is not left in the state you were given it.

    1. Such costs may be charged on check-out but Ari Apartments Ltd reserves the right to apply such charges to your card at a later date where necessary.

    2. Where Ari Apartments Ltd is unable for any reason to apply such a charge against your credit/debit card then an invoice will be sent to you and which you agree to pay within 14 days of receipt.

    3. Ari Apartments Ltd will provide a receipt including a break-down of costs for all additional charges made to your credit or debit card.

    4. We reserve the right to make reasonable amendments or additions to these terms and conditions without notice.


  1. Privacy, Data Protection and Credit/Debit Card Security

    1. Ari Apartments Ltd processes information about you that you provide when making a reservation and/or upon check-in in accordance with our privacy policy (please request a copy if you would like to see this). By providing this information you consent (on your behalf and on behalf of each member of your group) to such processing and you warrant that all information provided by you is accurate.

    2. You should note that we are required by law to maintain a register of all guests ID’ names and nationality (to be taken in advance of your stay) Immigration (Hotel Records) Order, 1972 and to keep such details on file for at least 12 months from the date of arrival. In addition, for guests who are not of British, Irish or Commonwealth nationalities we are required to take details of your passport or other travel documentation and the address of your next destination.

    3. We use a secure system to collect guest ID – and all data is stored and held on this database until such time it is no longer required or reaches the 12 month holding period.     5. We use a secure third party service to process card payments Stripe. This service is PCI-DSS compliant and allows us to make charges to your credit and debit card in accordance with these terms.   1. Complaints

    1. Ari Apartments Ltd want to ensure that you have an enjoyable stay.

    2. If you have a problem during your stay please talk to any member of staff who will be able to help you.

    3. If Ari Apartments Ltd are unable to informally resolve any complaint you have at the time of your stay then you may submit a formal complaint in accordance with this procedure. Formal complaints should be submitted in writing using the contact details below. Please provide as much information as possible in order that Ari Apartments Ltd may properly investigate your complaint.

    4. Your complaint will be dealt with by an appointed member of the Ari Apartments Ltd management team. Ari Apartments Ltd aims to respond to formal complaints within 2 business days but if this will not be possible Ari Apartments Ltd will notify you of this and of when it expects to respond. Ari Apartments Ltd will set out the outcome to your complaint in writing.

    5. Ari Apartments Ltd reserves the right to reject without further investigation any vexatious complaint or complaint made in bad faith.

  2. Limitation of Liability

    1. The liability of Ari Apartments Ltd to you under these terms and conditions shall be limited to the total value of your booking (unless the Hotel Proprietor’s Act 1956 applies, in which case our liability will be limited to the maximum prescribed under that Act) except where such loss is caused by our

      negligence, in which case it shall be limited to any direct and reasonably foreseeable loss suffered by you.

    2. Ari Apartments Ltd shall not be liable in any circumstances to you for any consequential or indirect loss including loss of profit, data, management time, reputation or goodwill.

    3. Ari Apartments Ltd shall not be liable for any damages or loss caused by conditions or events beyond its control including, but not limited to:

      1. Strike, lockout or other labour dispute affecting the employees of Ari Apartments Ltd;

      2. Acts of God;

      3. Natural disasters;

      4. Acts of war or terrorism;

      5. Act or omission of government, highway authorities or telecommunications carrier, operator or administrator;

      6. Delay in manufacture, production or supply by third parties of equipment or services required for the performance of the Services or production and supply of the Goods;

      7. Any negligence on the guest part which may have caused damage or loss.


    4. Nothing in this clause or these terms shall limit Ari Apartments Ltd’s liability for death or personal injury or in respect of fraudulent misrepresentation.

    5. Ari Apartments Ltd cannot be held responsible for any personal injury, loss or damage to personal effects howsoever arising at the accommodation.

    6. Any detergents, soaps or chemicals left at the property is used at your own risk, please check labels prior to using anything.

    7. Although our apartments are professionally cleaned after every stay, our properties are not guaranteed to be allergen free, if you do suffer from allergies please take necessary precautions.

    8. Parking your vehicle – you park your vehicle in the spaces provided at the owner’s risk and Ari Apartments Ltd are not liable for any loss or damage to the vehicle.


  3. Severability

    1. If any provision or provisions of these terms and conditions shall be held to be invalid, illegal, unenforceable or in conflict with the law of any jurisdiction, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.


  4. Waiver

    1. The failure of any party at any time to require performance of any provision or to resort to any remedy provided under these terms and conditions shall in no way affect the right of that party to require performance or to resort to a remedy at any time thereafter, nor shall the waiver by any party of a breach be deemed to be a waiver of any subsequent breach. A waiver shall not be effective unless it is in writing and signed by the party against whom the waiver is being enforced.


  5. Entire Agreement

    1. These terms and conditions constitutes the entire agreement of the parties and supersedes all prior communications, understandings and agreements relating to the subject matter hereof, whether oral or written.

  6. Third party rights

    1. Nothing in this Agreement is intended to, nor shall, confer any rights on a third party unless expressly provided otherwise


  1. Jurisdiction

    1. This Agreement shall be construed in accordance with English Law and the Courts of England and Wales shall have exclusive jurisdiction in so far as any matter arising from this Agreement is required to be referred to a court of law.


If guests are in breach of any of these conditions we reserve the right to request that guests vacate the property immediately


Ari Apartments Ltd may request further identification for guests staying in the accommodation to satisfy any further requirements.
